QERNEL LLC, doing business as FlipMyAI ("FlipMyAI," "we," "us"), provides AI setup, configuration, troubleshooting, and consulting services. All services are delivered virtually unless otherwise agreed in writing.
Each engagement begins with a complimentary diagnosis session. During this session, we identify the issue and establish a clear scope before any paid work begins. You will know the expected cost and deliverables before proceeding.
Pricing is communicated during the diagnosis session and agreed upon before work begins. Payment is due upon completion of the session. We accept major credit cards and standard payment methods.
Any configurations, scripts, or documentation created during a session are provided for your use. We do not claim ownership of your data, accounts, or systems. You retain full ownership of your infrastructure and credentials.
All services provided by FlipMyAI are advisory and consultative in nature. We provide recommendations, guidance, and technical suggestions based on our experience. The decision to implement any recommendation is solely at your discretion and responsibility. We do not guarantee specific outcomes, results, or performance improvements.
We do not provide legal, financial, medical, or compliance advice. Any implementation of our recommendations is undertaken at your own risk. You are responsible for evaluating the suitability of any recommendation for your specific environment before acting on it.
We treat all client information as confidential. NDAs are available upon request for enterprise engagements. We will not disclose your information to third parties without your consent.
All services are delivered via phone, video call, or secure access tools. During sessions, our team operates with read-only or view-only access unless you explicitly grant additional permissions. We do not store, retain, or have ongoing access to your systems, data, accounts, or credentials after a session concludes.
You are solely responsible for maintaining backups of your data, configurations, and systems prior to any session. FlipMyAI is not responsible for any data loss, corruption, or unintended changes that may occur in your environment during or after a session, including those caused by third-party tools, services, or platform behavior outside our control.
Service timelines are estimated based on the scope agreed during the diagnosis session. Actual completion times may vary depending on the complexity of your environment and third-party service availability.
You may cancel or reschedule a session at any time before it begins at no charge. For sessions already completed, refund requests are reviewed on a case-by-case basis within 7 days of the session. AI Concierge subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period. Fees for the current billing period are non-refundable.
All services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. FlipMyAI does not warrant that any recommendation will achieve a specific result or that any AI tool or third-party service will function as expected.
To the maximum extent permitted by law, FlipMyAI and its officers, employees, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services, including but not limited to data loss, data corruption, revenue loss, business interruption, system downtime, configuration changes, account access issues, security incidents, or third-party service disruptions.
FlipMyAI provides recommendations only. All implementation decisions are made at your sole discretion and risk. FlipMyAI does not have control over your data, systems, or third-party platforms at any time. We are not responsible for any outcomes resulting from actions you take based on our recommendations, whether during or after a session.
In no event shall FlipMyAI's total aggregate liability exceed the amount you paid for the specific service giving rise to the claim.
You agree to indemnify and hold harmless FlipMyAI, QERNEL LLC, and its officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your implementation of any recommendations, or your violation of these terms.
These terms are governed by the laws of the State of Washington, United States.
